If Service Canada denies CPP Disability at reconsideration, you may be able to appeal to the Social Security Tribunal of Canada. The SST is independent from Service Canada and hears appeals about CPP Disability, post-retirement disability benefits, and related benefits.
An appeal can feel intimidating, but the process becomes clearer when you know the steps.
You cannot usually go straight from the first denial to the SST. First, you ask Service Canada to reconsider. If you disagree with the reconsideration decision, then you can appeal to the SST General Division.
The SST says it must receive the appeal within 90 days after you receive the reconsideration decision. This makes the reconsideration letter date very important.
To start, you complete and send a Notice of Appeal for Income Security. In the form, you explain why you are appealing and can identify the type of hearing you want. You may also ask for accommodations or an interpreter if needed.
The reasons for appeal should be specific. For example, you might argue that the evidence shows you cannot work regularly, that Service Canada misunderstood your work attempt, or that new medical records clarify the prognosis.
After the appeal is filed, the SST tells you it has received the appeal and notifies Employment and Social Development Canada. Documents are shared, and a General Division member is assigned. The process includes time for both sides to provide documents and respond.
This is why organization matters. Keep a timeline of your disability, a list of medical evidence, and a clear explanation of why the severe and prolonged test is met.
A hearing is your chance to explain your situation and answer questions. It is not about proving that you are a good person or that you worked hard. It is about proving eligibility under the CPP rules.
After the hearing, the SST usually sends the decision in writing. If you have a representative, they receive it too. If the General Division decision is unfavourable, there may be a further Appeal Division path, but the rules are different and usually focus on errors rather than simply rehearing the whole case.
If your reconsideration was denied, DCAC can help you understand the appeal path and prepare your evidence before the SST deadline.
